Definitions:
- Ministry: The Ministry of Commerce.
- Website: The Ministry's official website (www.mc.gov.sa).
- Application: Ministry’s mobile application
- Contact Center: The unified contact center of the Ministry Commerce (1900).
- Live Chat: Instant messaging channels with customer service representatives available on the website, application, or other communication channels.
- Contact Forms: Digital forms used to submit inquiries, complaints, support requests, or assistance requests.
- Digital Channels: All digital channels associated with the Ministry, including the website, application, contact center, live chat, and contact forms.
- Branches: The physical branches affiliated with the Ministry of Commerce.
- Links: Any element or content that directs the user to another element or content through clicking, tapping, tabbing, or hovering.
- Data: A collection of facts in their raw or unstructured form, such as numbers, letters, images, videos, audio recordings, or emoji.
- Personal Data: Any information—regardless of its source or form—that could specifically identify an individual or make them identifiable, either directly or indirectly, when combined with other data. This includes, but is not limited to, name, contact numbers, bank account details, credit card information, static or dynamic images of the user, and other personal information.
- Privacy Policy: A document that outlines the rights of data subjects and the obligations that must be adhered to.

Terms of Use:
Ministry's digital channels are available for personal use. Your access and use of these channels are subject to these terms and conditions, as well as the laws of the Kingdom of Saudi Arabia. By accessing and using these digital channels, you unconditionally agree to these terms and conditions and to the Privacy Policy, whether you are a registered user or not. This consent becomes effective from the date of your first use of the service.
Any amendments to these terms and conditions will become effective immediately upon approval by the Ministry unless stated otherwise. Continued use of these digital channels after any modification of the terms and conditions or the Privacy Policy constitutes acceptance of the changes.

Usage Restrictions:
By using the digital channels, you commit to providing accurate information and maintaining respectful conduct when communicating with service providers. You also agree to refrain from the following:
Obtaining personal benefits from the services or information provided through the digital channels without prior authorization from the Ministry's authorized personnel.
Using the digital channels to send unsolicited commercial emails, spam, or engage in any similar misuse.
Publishing, advertising, distributing, or circulating defamatory, illegal, obscene, or offensive materials or information through the digital channels. This includes refraining from capturing images or recordings of the services for defamatory or illegal purposes.
Engaging in any illegal or unauthorized activities through the digital channels or advertising any product or service that would place the Ministry in violation of applicable laws or regulations.
Disclosing request identifiers or personal data to others, which could result in unauthorized access to your data through the digital channels.
Uploading or providing files containing software, materials, data, or other content that you do not own or have not been licensed or authorized to use.
Uploading or providing files containing viruses or corrupted data on or through the digital channels.
Engaging in any activities that could compromise the security of the digital channels or disrupt their functionality.
Performing actions that impose an excessive load on the digital channels' infrastructure or affect the integrity, reliability, or availability of the information.
Using any method, software, or process to interfere with or attempt to interfere with the proper functioning of the digital channels.
Copying or modifying the source code of the digital channels or associated services.
Extracting derivative works or source codes into independent files (e.g., APK, IPA, XAP).
Engaging in any activity that violates the laws of the Kingdom of Saudi Arabia, particularly those related to information security, personal data protection, electronic transactions, the policies outlined in the Ministry's digital channels, and anti-cybercrime regulations.

Links to the Ministry’s Digital Channels:
It is prohibited to reproduce or copy any content from the Ministry’s digital channels, create any electronic links to them, or display any of their content within a frame that does not comply with these terms and conditions. The Ministry reserves the right to impose conditions upon granting permission for linking to these digital channels or any of their content, or for displaying any of their content or services on any other website, portal, or digital platform.

The Ministry shall not, under any circumstances, be deemed as associated or affiliated in any way with any trademarks, logos, commercial symbols, service marks, or any other means used or appearing on websites containing links to these digital channels or any of their content unless explicitly approved by authorized personnel within the Ministry.
The Ministry reserves the right to disable or obstruct any form of linking from any site containing inappropriate, offensive, infringing, obscene, pornographic, indecent, unacceptable, illegal, or otherwise objectionable content. This also applies to sites containing names, materials, or information that violate any law or infringe on intellectual property rights, privacy rights, or publicity rights.

The Ministry assumes no responsibility for the content available on any external website accessed through these digital channels or for the content available on any website linking to these digital channels.
 
Links from the Ministry’s Digital Channels:
The Ministry provides electronic links to external elements, including portals, websites, applications, or other links, to facilitate user access and enhance their experience. However, the Ministry does not bear any responsibility for the content or credibility of these external elements. The inclusion of these links does not imply the Ministry’s endorsement of their content.

The use of these links to access external elements is solely at the user’s risk. The Ministry makes efforts to replace non-functional electronic links, but it does not guarantee the continuous functionality of these links.

Intellectual Property Rights:
These digital channels are supervised by the Ministry, and all content within them, including software and information, is fully protected under the copyright laws, trademark laws, and various intellectual property laws of the Kingdom of Saudi Arabia.

All intellectual property rights for the content of the digital channels are owned by the Ministry and are protected under copyright law, unless otherwise stated. You are prohibited from selling, licensing, renting, modifying, copying, reproducing, reprinting, downloading, publishing, transmitting, distributing, publicly displaying, editing, or creating derivative works from any materials or content on these digital channels for public or commercial purposes without prior written consent from the authorized personnel within the Ministry. Any modification of the content within these digital channels is strictly prohibited.

Legal Jurisdiction:
Your use of these channels is subject to all applicable laws and regulations within the Kingdom of Saudi Arabia. By using these channels, you agree to submit exclusively to the judicial authorities of Saudi Arabia for all claims and disputes arising from this usage.
 
Limitation of Liability:
The services and information provided through the digital channels are intended solely to facilitate manual procedures. You acknowledge that internet communications may be subject to interference or interception by third parties, and that the digital channels do not replace the information available through official authorities. Consequently, the Ministry shall not, under any circumstances, be liable for any loss or damage of any kind resulting from your use or visit to the digital channels.
 
Termination of Use:
The Ministry, at its sole discretion, may terminate, restrict, or suspend your right to access and use the digital channels without prior notice and for any reason, including but not limited to violations of these terms and conditions or if you engage in unlawful or harmful conduct.

Virus Protection:
The Ministry makes every effort to scan and test the content of the digital channels at all stages of development. However, you are advised to always run antivirus programs on any materials downloaded from the platform. The Ministry is not responsible for any loss, interruption, or damage to your data or communication devices caused during the connection to these digital channels or the use of elements obtained from them.

Waiver of Claims:
The digital channels, along with the services, information, materials, and functions available through them, are provided "as is" and "as available." The Ministry makes no representations or warranties, express or implied, of any kind.

Compensation:
Under this agreement, you acknowledge and agree not to take any legal action against the Ministry or any of its departments or claim any compensation or liability insurance. You also release any entities, employees, or agents tasked with managing, maintaining, updating, or providing the digital channels from any obligations or liabilities that may arise concerning any claims resulting from your breach of these terms and conditions or any applicable laws, whether in the Kingdom of Saudi Arabia or the country where you reside.

You also acknowledge full responsibility for compensating the Ministry for any losses or damages resulting from your failure to comply with the terms and conditions outlined in this agreement. This includes, but is not limited to, compensating the Ministry for legal expenses and fees, amounts awarded in judgments to third parties, and costs and fees for lawyers, experts, and technicians engaged by the Ministry during the course of any legal proceedings.

User Identity and Passwords (Security):
You acknowledge the responsibility of safeguarding your username and passwords used within the digital channels and agree not to engage in any actions that could disclose them to any third party. The account should only be used by the user or by an authorized representative approved by the Ministry. You are fully responsible for any use related to this account and the consequences resulting from its use.

You must promptly notify the Ministry if you become aware that the password has been compromised, if a security breach occurs, or if you discover any unauthorized activity on your account through the digital channels.
 
Digital Participation:
Community participation has gained significant importance, providing citizens with various means to contribute and ensuring that their opinions and suggestions reach all decision-making centers.

The Ministry ensures supervision of all participations and reviews them before publication to ensure compliance with state laws and to promote high-level dialogue to achieve desired objectives. The Ministry reserves the right to refrain from publishing or to delete any content it deems inconsistent with its policies or the applicable laws of the Kingdom of Saudi Arabia. The Ministry is not obligated to publish all contributions, nor can it, under any circumstances, be held legally responsible for the content of comments or feedback published through its digital participation channels.

By participating, you agree to the following community participation rules and guidelines:

Compliance with relevant state laws.
Contributions must be written in clear language.
Avoid sending the same contribution more than once.
Refrain from using offensive language.
Contributions should be serious, objective, clear, and concise.
Do not publish personal data, such as names, contact details, or addresses.
Do not misuse the Ministry's digital channels in a way that affects their performance, security, speed, or continuity.
 
​Authority over Digital Participation:
The unit responsible for overseeing digital participation and consultations related to public contributions in developing regulations and legislation is tasked with supervision. The supervising entity varies depending on the nature of the regulation or legislation under review, with a specialized team formed before launching each survey.
Regarding idea submissions through other digital participation and consultation channels, the Planning and Business Development Department is responsible for overseeing them.

Notifications:
You acknowledge that any communication details provided in the Ministry's digital channels (such as mobile number, telephone number, email address, or mailing address) are the appropriate means for notifications and correspondence.
Notifications directed to the Ministry should be sent through the channels listed below, provided that confirmation of receipt from the Ministry is obtained:

General Provisions:
Arabic is the primary language for using or benefiting from the digital channels. Any translation of these materials is provided as an added service. Therefore, the translated versions cannot be relied upon to interpret any disputes regarding the content of the digital channels.
All regulations and laws published on the digital channels, whether related to the Ministry or other entities, may be translated to clarify their meanings as an added service. However, the Arabic text of all these regulations and laws is the primary reference. Therefore, interpretive translations cannot be relied upon to extract any details or information.
The digital channels include several tools and channels for digital participation, such as forums, polls, comments on published content, blogs, voting systems, visitor comments, personal subscriptions, text messages, and 24-hour toll-free services. The Ministry has set several standards and restrictions for using all digital participation channels to ensure the highest benefits from the principle of digital participation. By using these channels, you provide ongoing acceptance of the standards and restrictions associated with their use.
The Ministry reserves the right, at its sole discretion, to delete or refrain from publishing any comments or participations from users of the digital channels.
